TERMS OF
SERVICE.
Last updated: 28 March 2026 · Effective: 28 March 2026
Please read these Terms carefully before using TrustArc. By accessing or using our platform you agree to be bound by these Terms and all applicable South African law.
1. About TrustArc
TrustArc (Pty) Ltd ("TrustArc", "we", "us", "our") is a Cape Town-based transport marketplace registered in South Africa.
TrustArc is a marketplace, not a transport provider. We provide a technology platform that connects independent drivers and fleet operators with passengers seeking transport services. The transport contract is formed directly between the passenger and the driver or fleet operator. TrustArc is not a party to that contract and bears no liability for the transport service itself, except as expressly stated herein.
2. Acceptance of Terms
By registering an account, accessing, or using the TrustArc platform (web or mobile), you confirm that you are at least 18 years old, legally capable of entering into binding contracts under South African law, and that you accept these Terms in full.
If you are registering on behalf of a company or fleet, you warrant that you have authority to bind that entity to these Terms.
3. User Roles & Eligibility
The platform supports three user roles:
- Passengers — individuals booking transport services
- Drivers — independent operators providing transport in their own vehicles
- Fleet Owners — businesses or individuals managing multiple vehicles and drivers
Drivers and fleet owners must hold all valid South African licences, permits (including applicable Operating Licences under the National Land Transport Act), and insurance required to operate commercially. TrustArc reserves the right to verify documentation and suspend accounts that do not comply.
4. Account Registration
You must provide accurate, current, and complete information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@trustarc.co.za if you suspect unauthorised access.
TrustArc reserves the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in conduct harmful to other users or the platform.
5. Passenger Obligations
As a passenger you agree to:
- Provide accurate pick-up, drop-off, and contact information for each booking
- Be present and ready at the agreed pick-up time
- Treat drivers with respect and comply with their reasonable instructions
- Not request transport for any unlawful purpose
- Pay for services as confirmed at the time of booking
- Not submit fraudulent disputes or chargebacks without legitimate cause
6. Driver & Fleet Owner Obligations
As a driver or fleet owner you agree to:
- Maintain valid driving licences, PDP (Professional Driving Permit), and vehicle roadworthiness certificates at all times
- Hold valid third-party liability insurance and, where applicable, passenger liability cover
- Comply with all applicable traffic laws and the National Road Traffic Act
- Complete accepted bookings punctually and professionally
- Not carry passengers while under the influence of alcohol or any impairing substance
- Keep vehicle information on the platform accurate and up to date
- Not engage in price manipulation, fake bookings, or fraudulent activity
7. Bookings & Cancellations
Passenger cancellations: Bookings cancelled more than 24 hours before the scheduled time are fully refunded. Cancellations within 24 hours may incur a cancellation fee as displayed at the time of cancellation.
Driver no-shows: If a confirmed driver fails to arrive without cancelling in advance, affected passengers are entitled to a full refund. Repeated driver no-shows may result in account suspension.
Subscription plans: Monthly subscriptions may be cancelled before the next billing cycle. No refunds are issued for the current billing period unless required by the Consumer Protection Act.
8. Payments & Fees
All prices displayed on the platform are in South African Rand (ZAR) and are inclusive of VAT where applicable. Payments are processed by our third-party payment provider. TrustArc charges a platform service fee which is disclosed before booking confirmation.
Driver and fleet owner earnings are subject to the commission structure agreed at the time of registration. Payouts are processed according to the schedule communicated in your account dashboard.
9. Ratings & Reviews
TrustArc operates a mutual rating system. Ratings must reflect genuine experience and not be submitted maliciously, fraudulently, or as part of a coordinated campaign. We reserve the right to remove reviews that violate these standards.
10. Prohibited Conduct
You may not use TrustArc to:
- Engage in any unlawful activity
- Harass, threaten, or harm any user
- Circumvent the platform to arrange off-platform payments with the intent to avoid service fees
- Introduce malware, scrape data, or interfere with platform infrastructure
- Misrepresent your identity, credentials, or vehicle details
- Discriminate against any user on grounds of race, gender, religion, disability, or any other ground prohibited under South African law
11. Limitation of Liability
To the maximum extent permitted by South African law, TrustArc's liability to you for any claim arising out of or related to these Terms or your use of the platform is limited to the amount you paid to TrustArc in the 3-month period preceding the claim.
TrustArc is not liable for the acts or omissions of drivers, fleet owners, or passengers, delays, accidents, or losses arising from transport services arranged through the platform. Nothing in these Terms limits liability for death or personal injury caused by our gross negligence, or any other liability that cannot be excluded under the Consumer Protection Act 68 of 2008.
12. Intellectual Property
All content, trademarks, and technology on the TrustArc platform are owned by or licensed to TrustArc. You may not reproduce, distribute, or create derivative works without our prior written consent. You grant TrustArc a non-exclusive, royalty-free licence to use content you submit to the platform (e.g. reviews) to operate and improve our services.
13. Dispute Resolution
We encourage users to resolve disputes amicably by contacting our support team first at support@trustarc.co.za.
If a dispute cannot be resolved informally, it shall be submitted to mediation in Cape Town before either party initiates litigation. These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. The parties consent to the jurisdiction of the Western Cape Division of the High Court of South Africa.
14. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes at least 14 days before they take effect via email or in-app notification. Continued use of the platform after the effective date constitutes your acceptance of the revised Terms.
